1. Acceptance of Terms

By accessing and using Adventure Active Canada's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms apply to all visitors, users, and others who access or use our outdoor adventure services, website, and related platforms.

If you do not agree with any part of these terms, you may not access the service or participate in our adventure programs. We reserve the right to update these terms at any time without prior notice.

2. Service Description

Adventure Active Canada provides outdoor recreation services including but not limited to guided hiking expeditions, wilderness kayaking adventures, winter snowshoeing tours, climbing instruction, survival skills workshops, and photography programs throughout Canada's wilderness areas.

All activities are conducted by certified guides and instructors who prioritize safety and environmental stewardship. Participants must meet specific age, fitness, and experience requirements as outlined for each program.

3. Booking and Payment

All bookings must be confirmed with full payment or approved payment plan before participation. Cancellation policies vary by program duration and season. Standard cancellations made more than 30 days in advance receive full refund minus administrative fees.

Weather-related cancellations initiated by Adventure Active Canada result in full refund or rescheduling options. Participants who cancel due to weather concerns may reschedule subject to availability but are not eligible for refunds unless the program is officially cancelled.

4. Health and Safety Requirements

Participants must complete health questionnaires and liability waivers before program commencement. Certain medical conditions, medications, or physical limitations may preclude participation in specific activities for safety reasons.

All participants are required to follow guide instructions, use provided safety equipment properly, and inform guides immediately of any health concerns or equipment malfunctions. Adventure Active Canada reserves the right to remove participants who compromise group safety.

5. Risk Acknowledgment and Liability

Outdoor adventure activities involve inherent risks including but not limited to weather exposure, terrain hazards, wildlife encounters, equipment failure, and potential for serious injury or death. Participants acknowledge these risks and participate voluntarily.

Adventure Active Canada maintains comprehensive liability insurance and follows industry safety standards, but participants assume responsibility for their personal safety and must sign liability waivers acknowledging the inherent risks of wilderness activities.

6. Environmental Responsibility

All participants must adhere to Leave No Trace principles and respect wildlife, vegetation, and natural resources. Littering, harassment of wildlife, or damage to natural areas may result in immediate program termination without refund.

We partner with Parks Canada and indigenous communities to ensure our activities support conservation efforts and respect traditional land use practices. Participants are expected to embrace these values throughout their adventure experience.

7. Equipment and Personal Property

Adventure Active Canada provides specialized safety equipment, but participants are responsible for personal gear as specified in program requirements. Lost or damaged company equipment may result in replacement charges.

The company is not responsible for loss, theft, or damage to personal property during programs. Participants are strongly encouraged to secure appropriate travel and equipment insurance before program commencement.

8. Photography and Media

Adventure Active Canada may photograph or video record programs for marketing, educational, and promotional purposes. Participation constitutes consent for use of participant images unless specifically declined in writing before program start.

Participants retain rights to their personal photography but agree not to use Adventure Active Canada branding or guide likeness for commercial purposes without written permission.

9. Governing Law and Dispute Resolution

These terms are governed by the laws of Alberta, Canada. Any disputes arising from these terms or participation in our programs will be resolved through arbitration in Calgary, Alberta, following Canadian arbitration procedures.

Participants waive rights to class action lawsuits and agree to resolve disputes individually through the specified arbitration process before pursuing other legal remedies.
